Mediation is a structured process to prevent and resolve disputes outside the courts.
It proceeds from the parties will to try and resolve a dispute with the help of a third party called a mediator.
Appointed by the parties, the mediator is confirmed by AFA Mediation Committee; he is independent and impartial. In this communication process, his role is to help parties find a mutually beneficial solution.
To this effect, parties, their counsel and the mediator must comply with the following rules:
- Confidentiality
- Freedom of entering and going out mediation
- Freedom of speech
- Non-interruption
- Possibility to have separate interviews
