puce_AFA What is mediation?

Mediation is a structured process to prevent and resolve disputes outside the courts.

It proceeds from the parties will to try and resolve a dispute with the help of a third party called a mediator.

Appointed by the parties, the mediator is confirmed by AFA Mediation Committee; he is independent and impartial. In this communication process, his role is to help parties find a mutually beneficial solution.

To this effect, parties, their counsel and the mediator must comply with the following rules:

  • Confidentiality
  • Freedom of entering and going out mediation
  • Freedom of speech
  • Non-interruption
  • Possibility to have separate interviews

The flexibility of its regulations and the confidentiality of the process are two of the main attractive features of AFA ’s mediation.
